I'm after some advice, as to avoid taking up an appointment at an immigration office to get more info...

Seperate to the Visa-Free travel allowed using the 90/180 approach, we are planning to leverage the Bilateral Agreement from circa 1952 between Germany and Australia.

However, I'm really struggling to grasp what is allowed and what isn't.

In short, i'm very keen to understand what the wording below means:
According to this agreement the duration of one stay in Germany must not exceed 90 days but the number of entries to Germany is not limited. In order to re-enter Germany for another 90 days visitors have to depart Germany for any other country outside the Schengen States (e.g. the UK or Romania to name a few) and can come back even the same day.

Main Questions:
- Can we enter Germany for up to 90 days and then leave for a non-Schengen state (e.g. UK) and return to Germany again for potentially another 90 days?
- Is there any limit to the amount of times we do this? Provided no visit exceeds 90 days?
- Is there anything we should have on hand to show Immigration when we first leave?

To confirm: this is for only tourist purposes, we have full travel/health insurance and we will not need to work.

I just want to make sure when we first leave, we're definitely allowed back! I've known someone who has successfully done this, but he did say it can depend on who you speak to...

Yes, but your second stay can only be in germany

you can do this as long as you dont exceed 90 days in germany in one stay. for example: you have been in germany (schengen) for 90 days. Leave to the UK. Re-Enter germany on the very same day. after five days you travel to turkey. you come back again on the very same day. now you can stay in germany for 90 days again

you have to remember that it affects potential stays in other schengen countrys.

most important is your passport. get your stamps in it. maybe have a copy of the information provided by the german embassy in australia on hand, so you can show this at the border if needed.

Also you have to leave and enter germany to a non schengen country directly, without a stay in another schengen country

Hi,

yes, there ist.
This kind of building a "chain of stays" should work 3 times in a row. Up to 3 times there should be no problems with the Immigration. You should just be able to inform them about this bilateral agreement, if needed (-> §16 AufenthV). The agreement itself you'll find here: Klick.
The Immigration (Bundespolizei) can find those regulations about that matters in their own regulations, called "BRAS 120".

If you would try this a 4th time, it can happen (and should happen), that they deny entry. Because more than three times using this regulations for short term stay assumes as being the etablishment of a permanent stay, which is not permitted by this binational agreement.
This is also regulated by the "BRAS 120".
