Hello everyone.
I live in Germany with a Duldung. I’m a non-EU citizen that got issued a Duldung because return isn’t possible for now due to illness(doesn’t affect me in conducting regular daily activities). I have presented my doctor’s medical certificate through my lawyer and I never at anytime applied for Asylum or any form of benefit from the government.

I have a German partner(unmarried but we live together, having the same Anmeldung and  joint bank acct) and she works full time.
I came to Germany legally with a Schengen visa before being issued a Duldung.
She wanted us to get married in January but we couldn’t due to German bureaucracy. Now she wants me to stay and she wants to know how she can apply for Verpflichtungserklärung(Declaration of commitment) for me.

All information gotten online talks about Verpflichtungserklärung for would-be unmarried partners who are still outside Schengen and none talks about the procedure for someone who is already in Germany with a Duldung like myself.
Pls, can someone advise on the procedure for applying for someone like me who has been in Germany for over a year and if her net salary that fluctuates between €1,500 and €1,700 is enough?
Also, how would she get me an insurance policy to cover me and how much will the insurance cost?

Again, here are my 3 questions:
(1)Can she apply Verpflichtungserklärung(Declaration of commitment) for me considering the fact that I’m already in Germany with a Duldung?
(2)Will the Ausländeramt mandate her to get me a health insurance? If yes, how can she?
(3)Will my status be changed from a Duldung holder without a work permit to someone with a Residence and working Permit so I can work and start paying tax?

Given the information that you have provided, you are not eligible for a German residence permit. Your lawyer should have already informed you of this fact.

Why are you asking about a VE? Germany does not issue residence permits to unmarried partners.

If you were to go home to organize the papers you need to get married here, you would need a VE for your visa application to cover the time from when you come back until you get married.

Like I said earlier, going back isn’t possible for now and I will be happy to return when it is?

Back to my question, which I think “maybe” you don’t want to answer, “can a German sign a VE for someone ALREADY LIVING IN GERMANY WITH A DULDUNG” saying she is standing to cater fully for this person without having to be a burden on the government?
Second question is, will he be issued a working permit if requested after he must have gotten the VE accepted(if possible atall)?

In a situation whereby the lady is undergoing serious emotional stress due to this, can anything be done to allow the man stay and issued a working permit, atleast for the emotional stability of the German National in question?

the man is allowed to stay as long as he can not travel home (this is "Duldung"), but this is not a residence permit.




Basically your question for VE is wrong questiion. VE is in certain cases precondition to get a Visa to enter Germany. To get a Shengen Visa (which you used to enter Germany) is such a case, so a VE might already be issued?
What you want to know is how to get a residence permit wiht status "Duldung".
In your case: almost no chance
even if you get married the ABH shall request you to leave Germany after you recover from your illnes and come back with a FZF Visa.

Working permit is not possible in your situation

If your plan was not to leave Germany by the end of Schengen Visa it was already ilegal to enter Germany.
