I have a question

As i mentioned in my previous post, I currently have a 18d VISA. It will expire in June 2023. I also did my masters in Germany and within 3 months of finishing my master's, I started my Ph.D. at another university. As you know, students who finished their studies will get 18 months of job search VISA. So, my questions are

1. As I have not used 15 months out of the 18 months that I am entitled to, can I use them again if my work contract is not extended?

2. If in case, the ABH agrees to that, will my previous employment period be counted for a settlement permit in the future if I get a job or will the 24 months start from scratch again? Thank you

Wie ich in meinem vorherigen Beitrag erwähnt habe, besitze ich derzeit ein VISA 18d. Es wird im Juni 2023 auslaufen. Ich habe auch meinen Master in Deutschland gemacht und innerhalb von 3 Monaten nach Abschluss meines Masters habe ich meinen PhD an einer anderen Universität begonnen. 1. Da ich 15 Monate der 18 Monate, auf die ich Anspruch habe, nicht genutzt habe, kann ich sie wieder nutzen, wenn mein Arbeitsvertrag nicht verlängert wird?

2. Wenn die ABH dem zustimmt, wird dann meine frühere Beschäftigungszeit für die künftige Niederlassungserlaubnis angerechnet, wenn ich eine Stelle finde, oder beginnen die 24 Monate wieder von vorne? Vielen Dank!

No, you are entitled to nine months as stated in sec. 20 (3) Number 2 AufenthG.

The law is not clear with regard to this problem, your might check with the respective authority. You might be also eligiable for a settlement permit according to sec. 9 (2) AufenthG as well: https://www.gesetze-im-internet.de/englisch_aufenthg/englisch_aufenthg.html#p0125

Yes, I am aware of that, but couldn't I use the unused months from the post-study work permit to which I am entitled? I thought I could you those 15 months plus these 9 months. Could you please mention the clause where they have mentioned that a student can not use the unused months if they changed the visa to another type.Thank you

It is not possible, because the 18 months in sec. 20 (3) 1 require a permit according to sec. 16b, which you no longer hold. The existence of number 2 for researchers derogates number 1 as a special clause in your case.
