Hi,
I am Turkish and my husband is Italian. Currently we are living in Italy and we will be moving in Berlin in the next couple of months as we both got job offer there.
We are a bit confused with all visa and permit process :-/
Some say as spouse of an EU citizen I have freedom of movement and I can take up any employment in Germany right away after arrival as long as also my husband is moving with me in Germany.
Some other say I need to apply for residence card for family reunion in Germany after arrival and until it is issued I am not allowed to work.
And some others say I need get a work visa otherwise there is no way for me start working right after arrival.

Has anyone had the similar experience or have any knowledge?

Thanks.

If your husband is/will be working in Germany, you definitely have the the right of free movement with him.

These others are mistaken.

That's correct. However in practice, you need to show your employer some kind of proof that you are allowed to work without restrictions. Therefore make sure, that once you have provided the local foreigners office (Ausländerbehörde) with all necessary information in oder to receive a residence card, a written confirmation is issued to you stating that you are allowed to seek employment without any restrictions (Erwerbstätigkeit erlaubt).

Thanks.
Therefore, this means that I can't start working until I receive written confirmation/proof that states I am allowed to work?

Curiosity, if the right of free movement comes from marriage why one needs another document to certify it and just marriage certificate is not enough?

Legally you are allowed to work without any proof. The written confirmation just makes it easier as many employers are not familiar with Freedom of Movement for third country nationals and therefore require some official documentation. Consult your future employer for further details.

A marriage certificate is a mere proof of marriage to a certain person. It does not provide further information about your entitlement to Freedom of Movment, whereas a residence card is a proof of an existing right to reside for the time of issurence.

You can start work immediately.  The challange is, if your employer is happy with an informal approval of your status. Talk to your employer about the proof he woul like accept until you have the residence card in your hand. Offer him a certified copy of the marrige certificate + copy Passport of you and your husband + copy of your registration in the resident register (Meldebescheinigung) it includes the citizenship of you and your husband.
