Student was failed to complete his degree on time, within reasonable 2 years. So, in the last semester he got an admission to another University. ABH rejected his visa extension application and gave him one months to voluntarily leave Germany. GÜB( Reason:  no residence permit available).

Student knows that, to change his University he must need permission from his current ABH. But, current ABH strongly objects. Should that student explain his situation to his desired new city ABH , if they have any different opinion and if they can help ?

However, he has filed a case in the Central Verwaltunggerricht Berlin by a lawer. By filing a case, will that student get a duldung from ABH ? Is the ABH obliged to issue him a duldung ? Or they can refuse a duldung ? As he has no visa now except his passport.

The student is not asylum seeker or refugee. What does this duldung will mean to him ? Can he enroll to a University with that duldung ? As University only accepts duldung of a refugee. The student is confused here, because if he even get a duldung from ABH, his duldung is not the purpose of refugee status seeking , it will be for a different reason. Will that duldung be any difference than a refugee status seeker duldung ?

Both, the Duldung and the GÜB imply that he must leave and does not have a right to stay in Germany (i.e. in the case of the GÜB at least not after the date stated on the GÜB).

Someone here will probably be able to answer the question on university enrollment later on.

Why are you posting here if the student (you?) already has a lawyer? Shouldn't these be questions for the lawyer?

because, unfortunately my lawyer has just took his fees and doesn't care. He has just filed a 2-3 line case, where ABH has a 14 page, and he doesn't even know hochschul part of the administrative law. He never replies email and barely available by telephone. As a lawyer, he was supposed to find a loophole and fix my situation, looks like he doesn't have any interest or busy with his big fish clients. As a student, I can't even afford to change a lawyer.

First of all, why do you keep starting new threads? If you keep all the information together in one thread it'll make it easier to understand your situation.

More importantly, what do you think your lawyer can do to fix your situation? What are you expecting?

Most universities will not let you register unless you have a residence permit and according to the info you've posted so far, you don't have a valid residence permit anymore.

On the other hand, the GÜB has a date by which you need to leave Germany. You were already told that in this thread.

Have you received a new GÜB? If not, have you made arrangements to leave Germany?

Yes, the GÜB was extended for 30 days.

Universitäten prüfen nicht das Aufenthaltsrecht. Kenne paar Studenten ohne Aufenthaltsrecht.
