Hallo!
Ich stell das mal hier rein, in der Hoffnung, dass jemand schon damit Erfahrungen gemacht hat - auch wenn es nicht um deutsches Recht geht. Mein Mann und ich überlegen, einen Kurztrip (2 Tage) nach Großbritannien zu machen. Er ist Bosnier und hat eine AE nach §28,1, für ein Jahr. Das heißt, er braucht ein Visum für GB. Allerdings ist mir nicht klar, welches, und ein Anruf bei der Visa-Hotline kostet günstige 2 Euro pro Minute... Es gibt ein normales Touristenvisum, das relativ teuer ist und für einen Kurztrip einfach nicht lohnt. Aber es gibt wohl noch eine andere Möglichkeit, wenn ich das richtig verstehe: "If you are the spouse, partner or child of a citizen of the European Economic Area (EEA) [wo Deutschland dazugehört] or citizen of Switzerland you may qualify for a European Economic Area Family Permit rather than a visa. The European Economic Area Family Permit is issued free of charge. To qualify you must be: * A non-European Economic Area citizen family member * Travelling with the European Economic Area family member or to join them if they are already in the UK. " Würd das für meinen Mann gehen? Oder geht es da nur um Familiennachzug? Hat jemand Erfahrungen damit gemacht, ob es einfach zu bekommen ist? Über Rat würde ich mich freuen - ich hab bis jetzt leider keine anderen Informationen dazu gefunden. Aber vielleicht wisst ihr was? Bei gemeinsamer Reise ist das das richtige Visum für ihn.
Der Aufwand für ein UK-Visum ist für einen Zweitagestrip unverhältnismäßig hoch:persönliches Erscheinen im Konsulat, detaillierte Beantwortung eines Katalogs von an die 100 Fragen, "Porto"-Gebühren von ca. 20€, ... Paris,Lissabon oder Stockholm sind auch sehr schön... |

Wenn dein Mann zusammen mit dir reist, so geniesst er von dir abgeleitete Freizuegigkeit. Dann koennt ihr fuer ihn einen EEA Family Permit (Application form VAF5) beantragen. Diesen gibt es kostenlos, jedoch muesst ihr fuer UK leider ein recht langes Formular ausfuellen. Informationen zum EEA Family Permit gibt es hier und die Seite mit den Visa Formularen gibt es hier. Ihr koennt das Formular aber auch online ausfuellen. In Deutschland werden Antraege ueber die Firma Worldbridge bearbeitet, auf deren Webseite gibt es weitere Infos. |

WorldBrigde hatte ich schon gefunden, war aber eben unsicher, ob diese EEA Family Permit für uns das richtige ist. Da der Aufwand aber offensichtlich wirklich sehr hoch ist, werden wir uns wohl für denKurztrip eine andere schöne europäische Stadt aussuchen und vielleicht später mal eine längere Reise nach GB machen... Wir selbst und auch viele unserer binationalen Bekannten haben auf Grund der umständlichen Verfahrensweise zur Erlangung des Family Permits bisher auf diese Reise verzichtet. Im Schengenraum gibt es genügend andere interessante Reiseziele, die ohne diesen bürokratischen Aufwand besucht werden können. Diese Bestimmung, §5(4) der Richtlinie, wurde in GB richtig umgesetzt, Reg 11(4), und wird meistens richtig angewendet, ist aber nicht garantiert. Sehr viel, was für ein EEA Family Permit verlangt wird, ist rechtswidrig. Dennoch, wenn man manche Dokumente nicht einreicht wird der Antrag abgelehnt. Somit ist eure Entscheidung verständlich. |

Euromover, das stimmt nicht. Zwar findet man die tatsächlichen Voraussetzungen unter EUN2.4, aber:
Fehlen die Angaben zur Finanzen und Unterkünften, so wird der Antrag wahrscheinlich abgelehnt, auch wenn diese sonst keine Rolle spielen. Fehlt eine Antwort, kann der Antrag abgelehnt werden. Das ist die rechtswidrige Praxis, ebenfalls manchmal sogar Vergleiche durch ECOs zu den nationalen MAA-Reglungen. ECOs (entry clearance officers) in Deutschland und Westeuropa sowie beim UK EC Hub New York sind allgemein besser, aber trotzdem. Nicht unmöglich ist sogar der Versuch, Regulation 12(1)(b)(ii) anzwenden, trotz dass diese seit EuGH Metock bekanntlich rechtswidrig ist, ZH (Afghanistan) v Secretary of State for the Home Department [2009] EWCA Civ 1060 Bei weiteren Fragen zum EEA FP kann man sich beim UK Resident Immigration Forum anmelden und fragen bzw. die Suchfunktion benutzen, da schon einiges dazu geschrieben wurde, zur Rechtslage und zur Praxis seitens des FCO (Foreign and Commonwealth Office, Außenministerium.) Ist der Antragsteller im Inland und beantragt er eine Aufenthaltskarte (residence card, Formular EEA2), so gibt es diese Probleme nicht. |

In meine efarung, man muss nicht alle fragen antworten. Meine Frau hat eine Irishsche visum gebrauched. Wir haben nichts uber Arbeit, gehalt, Irische Reiseziel, usw.. genatworted. Die Irishe had auf der Website gesagt: "All questions must be answered or the application will be refused." But the visa was not refused, and we went to Ireland!

Implementation of 2004/38 varies widely throughout the EU. The European Commission is aware that not one single member state implements the entire directive correctly. The UK's biggest problems are the EEA family permit procedure and excessive delays in processing. (Germany's biggest problems include the insufficient transposition and application of §3 of the directive, "beneficiaries", or as the UK calls them, "extended family members". You're right that corresponding problems do not arise with entry visas for spouses of EEA nationals. But for an extended family member, the UK is easier to deal with.) As for Ireland, I don't have detailed knowledge of their implementation in practice or of their procedures. But these have nothing to do with the UK. Personally I don't think the conduct of the Foreign and Commonwealth Office (being the Ministry responsible for ECOs) is appropriate. However unfortunately it is the way it is. There is always that risk of being refused, no matter what the content of the application and even when you answer all the questions. It is uncomfortable for all applicants for this very reason. There are no guarantees in life, and especially not in visas. You are dealing with an ECO who may or may not know the rules about what he can require, may or may not have gotten very drunk the night before, etc... When you find somebody who does not fully know the rules, you have to educate them. Any applicant can answer all the questions asked, and provide a whole lot of evidence. Non-EU family members have the option not to answer everything. They do have to be very clear in their cover letter that they are "Family members of EU citizens" and that they will be traveling with their EU citizen family member on the basis of EU free movement law. It is only if people regularly exercise their rights that the visa-sections will get educated and start always doing it correctly by default. Visas processed outside of the EU, where embassies of EU member states have less experience processing visas for family members of EU citizens, seem the most difficult for asserting EU rights. My sense is the visa sections inside the EU generally do a decent job now, and certainly better than they did a few years ago. The Irish no longer ask (most of) the questions we refused to answer. |

Hallo!
Ich krame noch mal mein altes Thema hervor. Wir (ich Deutsche, mein Mann Bosnier mit deutscher AE) wollen bald meinen Schwager und meine Schwägerin in Irland, Dublin, besuchen. Wenn wir schon mal dort sind, wollen wir vielleicht auch einen Ausflug nach Nordirland machen - ist ja nicht so weit. Ein Visum für meinen Mann für UK wollen wir natürlich nicht beantragen, der Aufwand lohnt sich nicht für einen Tagesausflug. Aber das wäre doch eigentlich die ideale Gelegenheit, dass wir es mal mit (wohl am besten internationaler?) Eheurkunde und dem Pass meines Mannes mit seiner deutschen AE an der Grenze versuchen. Liege ich da richtig, dass wir theoretisch reingelassen werden müssten? Falls es nicht klappt oder zu lange dauert, ist es ja auch kein Beinbruch. Dann setzen wir uns wieder ins Auto und fahren woanders hin. Hat denn mit dieser Konstellation, mit diesem Grenzübertritt schon jemand Erfahrungen gemacht? Dankeschön schon mal! |

[/quote] ja, dauerte am Tunnel halt 45 min. denn der Offizer musste zum Hauptgebäude laufen. Erklärte zunächst, dass das nicht geht. Als ich ihn auf die EU Freizügigkeit ansprach, dauerte es ein bisschen, dann ging das langsam seinen Lauf. Der eea family permit Stempel wurde gegeben und erklärt, dass wir das nicht zu oft machen sollten. Beim Flugzeug könnte dies anders sein, da man dann einfach nicht in den Flieger kommt. |

Beantragt haben wir das irische Visum noch nicht, weil die Reise erst für September oder Oktober geplant ist. Theoretisch bräuchten wir es zwar nicht, aber da wir vermutlich fliegen werden, ist es doch wieder nötig, weil die Airline meinen Mann ohne Visum wahrscheinlich nicht mitnehmen würde... Das irische Visum scheint aber einigermaßen leicht zu bekommen sein. Dass du selbst tatsächlich schon von Irland nach Nordirland gefahren bist und das ausprobiert hast, Chr76, ist beruhigend! Dass es gar keine Grenzkontrollen gibt, wusste ich nicht. Dann werden wir einfach Pass + Heiraturkunde dabeihaben und uns Nordirland ansehen! Ich freu mich drauf! Vielen Dank!! |
