Hallo,
ich bin neu hier, finde aber das Forum super, weil ich mich auch schon sehr über die Praxis der Visumerteilung geärgert habe. Und wahrscheinlich hätte ich mir auch ein wenig eigenen Ärger gespart, hätte ich die Beiträge hier vorher gefunden.
Kurz zu unserer Situation, meine Freundin hat auch eine Ablehung aufgrund fehlender Rückkehrwilligkeit bekommen. Dies wurde extrem schnell entschieden, max. 3 Tage.
Wir haben dann die
Remonstration geschrieben (mit zusätzlichen Belegen angereichert) und auch persönlich gemeinsam abgegeben, die Abgabe der
Remonstration war jedoch mehr eine Formalität, keine Nachfrage oder ein Interview.
Ich wurde in beiden Termin nicht zum Interview zugelassen. (Den Pinoy habe ich nicht gesehen, es waren bei uns jeweils nur Pinay dort.
)
Nun warten wir seit über 6 Wochen auf das Ergebnis der
Remonstration, gibt es irgendeine Möglichkeit hier schneller Klarheit zu bekommen? Das Warten macht einen richtig kirre und es sind auch schon eine Menge geplanter Termine hier in Deutschland vorbeigegangen (Konzerte, Familienfeste...).
Weil ich die Aufzählung von HeFi sehr sehr gut finde, habe ich es mal für meine Freundin ins Englische übersetzt, evtl. kann der ein oder andere dies ja auch brauchen, deswegen füge ich es hier an, vielen Dank nochmal für die Erläuterung.

The visa application process will be founded on "hard", reliable and verifiable criterias. Tipps which criterias will be vital are written in the VISA-Handbuch page 57 ff

1. property (real estate, car, bank account ... everything with value)
2. family ties in the country of origin
3. job, own business in the country of origin
4. stability of the circumstances of life in the country of origin
5. rootedness of the applicant in the country of origin
Proof of the social and economical rootedness of the applicant can be given by:
1. Recent chronological bank account statements of the last 6 months, savings and other properties
2. for emplyees: Written confirmation of the employer stating since when, in which position and with which salary and for which period the leave is granted.
3. for self employed: trade register excerpt
4. for students: enrollment documentation, certificate of study
Factors, which could raise doubts on the willingness of return (pls see VISA-Handbuch figure 7.12):
1. young, single, without children, living with parents, poor countries
2. internet acquaintance, false statement in your application
3. missing rootedness of the applicant in the country of origin, e.g. work, family, circumstances etc.
This has to be proven without contradictions by documentations. A particularly long applied visa stay without given appropriate evidence of the availability (e.g. approved leave of absent) proves an insufficient rootedness in the country of origin.
4. no private property, no high income, no means of existence in the country of origin
5. wrong statements of the purpose, e.g. tourist but (secretly) preparing to work, study, marriage and documents in preparation
6. purpose not believably proven
7. funding not proven, having already abused social benefits in one of the member countries
8. differences between statements in the visa application, interview and invitation
9. no detailed planned itinerary, long stay of visit of 3 months
10.Possibly missing return ticket (not mandatory according to Visa-Handbuch)
11.insufficient stability of the life circumstances in the country of origin
Evidence which could raise suspicion of bypassing the regular D-visa (marriage):
1. for already married people only a tourist visa there has been only an application for a tourist visa (instead of the family reunion).
2. If there are intentions noticeable, for which there is the need of a longer-term visa (e.g. work, study, marriage intentions etc.), then this might be a reason for a refusal due to doubts about the willingness to return.
