Hi,

Sorry, My german skills are very new.

Has any EC citizen had the experience of bringing their third country national parents to Germany? parents are dependent on me but the insurance requirement is confusing.

The competent authority (German Consulate in X) wants a letter from the statutory insurer (e.g TK) that they will insure my parents when they get their EU-Aufenthaltskarte else they are not going to give them a visa to enter the country.

I have reached a very frustrating point and I dont know what to do next. SOLVIT is not being responsive either.

Any thoughts appreciated.

There is no health insurance needed for the first 3 month if you are a eu citizen or a family member of a eu citizen.

The stay over 3 month is not the business of the german embassy/consulate. Refer to AVV zum FreizügG/EU 2.4.4

This Counselor official insists on this requirement and has given me a deadline of 31 October to comply of risk being denied a visa for my parents.

SOLVIT is being no help. I am now trying the "Gleichbehandlungsstelle EU-Arbeitnehmer" for help.

I talked to TK and because they are my dependent parents, they need to be assessed for new membership when they arrive. Unlike spouses or children who are automatically enrolled under the primary member.

to be honest, the competent authority is still trying to understand FreizügG/EU, forget about AVV zum FreizügG/EU. however, This clause is part of my objection letter to her that I am preparing.

I have landed an officer who is confusing German (National) Family Reunification procedure with FreizügG procedure.

I have one last try to convince her before she rejects the application of my parents.

She has done so with my sibling who I made a case for under Art 3 of 2004/38/EC, Other Beneficiaries. That I have referred to the EC because they already have a non-compliance case. However, she had no clue of 0.1.3 of AVV zum FreizügG/EU and used the Residency Act as the more favorable. But I knew this would be a tricky one and honestly, if she is struggling with FreizügG/EU...

But with my parents, I can't imagine such confusion. Even the team at Auslanderbehorde Dusseldorf is wondering why she is so confused.

Would you be able to check my logic? specifically why longer term insurance is not required as proof:

Source of the law lies in :

Sozialgesetzbuch (SGB) Fünftes Buch (V) - Gesetzliche Krankenversicherung – § 5 Versicherungspflicht - Foreigners ... shall be covered by the insurance obligation pursuant to paragraph 1 no. 13 if they have a residence permit or a residence permit with a For a period of more than 12 months according to the Residence Act

AND

because they were..

SGB 5.1.13..were not previously legally or privately insured

AND

because my parents would have a resident permit (valid for greater than 12 months) under...

Freizüg/EU §5 (1) - obliges a 5 year residence permit be issued to dependents once a positive determination has been made.

The other argument I have but probably just way too much, as it gets circular, is that she has ALREADY made a positive determination but only grants a temporary 6 month entry permit..violation of Freizüg/EU §5 (1)

Als Nicht EU Angehörige können Ihre Eltern zum Basistarif eine private KV abschliessen.
Kosten ca. 700-800 Euro p.m. p.Person.
Eine Aufnahme in die GKV ist meiner Meinung nach nicht möglich!

Kommt drauf an ob der Unionsbürger arbeitet oder nicht. Ist der Unionsbürger nicht erwerbstätig => Basistarif
Ist der Unionsbürger erwerbstätig => GKV möglich

Gehaltsabrechnung bei nicht-selbstständiger Erwerbstätigkeit bzw. bei selbstständiger Erwerbstätigkeit entsprechendes Dokument vom Steuerberater holen. Das musst du dann dem Ausländerbehörde vorlegen, wodurch diese keine Krankeversicherung mehr verlangen darf.

Ich möchte nur diesen Fall abschließen:

Meine Eltern haben ihre EU-Aufenthelskarte im Januar ohne Probleme erhalten. Der Beamte der Auslanderbehorde versuchte mir wegen BREXIT mitzuteilen, dass sie nur für eine 1-Jahres-Bewilligung berechtigt waren. Seine Entscheidung änderte sich, als ich sagte, ich werde dies mit dem BMI anfechten.

Die Techniker Krankenasse hat meine beiden Eltern in das Versicherungssystem aufgenommen. Dies geschah auf der Grundlage ihrer 5-jährigen Bewilligung UND der Tatsache, dass wir NICHT Kandidaten für nicht erwerbstätige Freizügigkeitsberechtigte sind. (NB: Sie wären nicht in das Versicherungssystem aufgenommen worden, wenn sie unterhaltsberechtigt waren (Abschnitt 4)).

Da ich durch die Arbeitslosenversicherung abgesichert war, wurde ich als "wirtschaftlich aktiv" eingestuft.

I just want to complete this case:

My parents received their EU residence card in January without any problems. The foreigner's officer tried to tell me because of BREXIT that they were only eligible for a one-year permit. His decision changed when I said I would challenge this with the BMI.

The Techniker Krankenasse has taken my two parents into the insurance system. This was done on the basis of their 5-year authorization AND the fact that we are NOT candidates for non-active vested benefits. (NB: they would not have been included in the insurance scheme if they were entitled to benefits (section 4)).

Since I was covered by the unemployment insurance, I was classified as "economically active".
